TERMS AND CONDITIONS

1. Scope of Service

ExpressResource Connect Limited provides comprehensive recruitment services, including sourcing, screening, and shortlisting qualified candidates based on the client’s specified requirements. We are committed to recommending candidates who not only meet the role specifications but also align with the organization’s values and culture.

2. Shortlisting and Client Feedback

Clients are encouraged to provide feedback or raise concerns regarding shortlisted candidates within five (5) business days of receiving the shortlist. Feedback must be submitted in writing via our official email. Upon receipt, we will thoroughly assess the feedback and, where deemed appropriate and feasible, may offer alternative candidate options in line with the agreed service terms.

3. Confidentiality of Candidate Information

All information related to candidates is strictly confidential and intended exclusively for the client’s internal recruitment purposes. The client agrees not to share, disclose, or forward candidate details to any third party without obtaining prior written consent from ExpressResource Connect Limited.

4. Payment Terms

To facilitate a seamless recruitment process, clients are required to settle all recruitment service fees in full before the final placement of any candidate. This payment confirms the client’s commitment and enables us to proceed confidently in identifying and recommending suitable candidates.

Should the client choose not to move forward with any of the shortlisted candidates, ExpressResource Connect Limited reserves the right to retain 30% of the total service fee to cover administrative expenses incurred during the sourcing and screening process.

5. Refund Policy

If the client decides to cancel the recruitment process, the remaining 70% of the service fee will be refunded within seven (7) business days of the confirmed cancellation, provided none of the introduced candidates have been engaged—either directly or indirectly—by the client or any associated entity. Once a candidate has been hired, the refund policy no longer applies.

6. Acknowledgment of Terms

By engaging our recruitment services, the client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this document.

7. Liability and Indemnity

ExpressResource Connect Limited will not be liable for any losses, damages, or claims arising from the client’s decision to engage or not engage any candidate recommended by us. The client acknowledges that the final hiring decision is solely their responsibility. The client agrees to indemnify and hold ExpressResource Connect Limited harmless from any claims, actions, or damages arising from the client’s use of our services.

8. Non-Solicitation of Candidates

For a period of twelve (12) months from the date of candidate introduction, the client agrees not to engage any candidate introduced by ExpressResource Connect Limited through any other means, including direct contact or third-party recruitment services, without prior written consent and the payment of applicable fees.

9. Candidate Replacement Guarantee

Should a candidate placed by ExpressResource Connect Limited leave the client’s employment within sixty (60) days of their start date, we will provide a replacement candidate at no additional cost, provided that the initial service fee has been fully settled and the departure was not due to redundancy, restructuring, or a change in job scope.

10. Data Protection and Compliance

ExpressResource Connect Limited is committed to protecting the privacy of candidate information in accordance with applicable data protection laws. All candidate data will be handled securely and will only be used for recruitment purposes as outlined in this agreement.
